Driving Lesson and Online Booking – Terms & Conditions
This Agreement is made between Ezy Drive Academy ("the Driving Instructor") and the booked client ("the Student") for driving lessons in South Australia. If the student is under 18 years of age, a parent or guardian must agree to the terms and conditions on their behalf.
By booking a driving lesson with Ezy Drive Academy, you agree to the following Terms & Conditions.
1. Eligibility
The student must hold a valid South Australian learner’s permit (or appropriate licence for the lesson type).
The student must bring their permit/licence to each lesson.
Lessons may be refused if the student is unlicensed, unfit to drive, or suspected to be under the influence of alcohol or drugs.
2. Lesson Bookings & Payments
All lessons must be booked in advance through our online booking system. For cash or BSB payment, please contact us directly to organise booking and payment.
Payment is required at the time of booking unless otherwise agreed.
Lesson durations include brief pre-lesson and post-lesson discussions and recording in the student's logbook.
3. Cancellations & Rescheduling
A minimum of 24 hours’ notice is required for the student to cancel or reschedule a lesson and 72 hours' notice for a Vehicle On Road Test (VORT) with an external examiner.
No refunds will be given for late cancellations or non-attendance.
Lessons may be rescheduled by the driving instructor (or examiner) due to weather, vehicle issues, sickness or safety concerns.
4. Punctuality
Lessons start at the scheduled time.
Late arrival by the student may reduce lesson time.
If the driving instructor is late, lesson time will be extended or adjusted accordingly.
5. Safety & Conduct
Lessons are conducted in a dual-controlled vehicle supplied by the instructor unless otherwise stated.
The student must NOT operate the instructor pedals fitted to the passenger seat footwell.
The instructor (or examiner) may take control of the vehicle at any time to maintain safety. This may include:
Grabbing the steering wheel from the passenger seat
Using the instructor pedals fitted to the passenger seat footwell
Lessons may be terminated if unsafe or inappropriate behaviour occurs, with no refund.
6. Vehicle Use
The student agrees to follow all road rules and instructor directions.
The student agrees to pay all fines and/or infringements incurred while in control of the vehicle.
7. Video & Audio Recording Consent
The student (and/or consent person if the student is under 18) gives permission for video and audio recording during driving lessons.
Recordings may include portable cameras, dash cameras, and audio. On occasion, the use of external cameras may also be used to film driving technique and social media clips.
Recordings may be used for:
Promotional and educational content, including social media, website use and advertising use
Driver training and feedback
Quality assurance
Insurance or incident review
Personal details will not be intentionally disclosed.
If consent is withdrawn, this must be provided in writing prior to the lesson. Withdrawal of consent may limit lesson availability.
8. Liability
While the student is in control of the vehicle, the student may be held liable for damage caused through negligence or failure to follow instructor (or examiner) directions, up to a maximum excess of AUD $1,250.00 (including GST), being the applicable insurance excess.
While all reasonable care is taken, Ezy Drive Academy is not liable for delays, missed tests, or outcomes beyond reasonable control.
Statutory consumer rights under Australian law are not excluded.
Ezy Drive Academy takes no responsibility for any failed tests including the Vehicle On Road Test (VORT).
9. Privacy
Personal information is handled in accordance with Australian privacy principles.
Information is used only for lesson delivery, communication, and legal requirements.
Your personal information may be shared with an external provider (such as a VORT Examiner or Government Official) as required.
Your instruction and lesson progress may be shared with your emergency contact (such as a parent, family member or friend, who you nominate during enrolment).
10. Dispute Resolution
In the event of any dispute arising under this Agreement, both parties agree to first attempt to resolve the matter through good-faith negotiations.
If mediation does not resolve the dispute within 30 days, either party may proceed to arbitration or legal action.
11. Acceptance of Terms
Booking a lesson online constitutes acceptance of these Terms & Conditions.
Completing the enrolment and consent forms also constitute acceptance.
